What is Additional filing used for?

Additional filing allows you to eFile documents and pay fees for an existing case on which you’re already associated. All practitioners acting in the case can lodge documents through Additional filing.

Meanwhile, ‘Add or Change Party’ allows you to file documents which change details about the case.

Do I need to be associated with the Parties/Litigants of a case?

Before you can use Additional filing, you’ll need to associate yourself with a Party/Litigant via Add or Change Party:

  1. Select the notice of appearance or changing practitioner document
  2. Click ‘Associate me’ for the person you represent.

If you’re associating yourself with an existing case, the initial document can be one of the following:

Once the County Court has processed this document, and you have obtained a ‘Filed’ result within the ‘Filing Results’ option, you may proceed to eFile any other document or fee.

How do I use Additional filing?

To use Additional filing, you must enter the Case Number you wish to file a document against and then retrieve the case.

When retrieving a case, the LSB Number you have associated with your account will be pre-filled for you. Your firm’s LSB Number (Solicitor Code) must be associated with the case before an Additional filing is allowed.

On the next screen, choose the document type and attach a document if required. You cannot upload documents that are encrypted or password protected.

Documents will ONLY be accepted if they match the defined A4 or US letter size.

How do I lodge payments for Setting Down for Trial, Jury and Hearing court fees?

You can lodge Setting Down for Trial, Jury and Hearing fee payments via Additional filing.

These types of lodgements don’t require you to upload a document and don’t require court review, provided payment is made before the due date.

Use the following document types for payments made before the due date:

3EJF1 First day jury fee before due date
3ESDT Setting down fee before due date

3ESDT is reserved specifically for payment of a Setting Down for Trial fee by the plaintiff before the plaintiff’s due date.

After this time, another ‘due date’ would apply for the payment, which could then be made by any party. If the fee is not paid, the trial date will be vacated.

Use the following document types for payments made after the due date:

An additional 14 day period after the due date applies for the First Day Jury Fee payment, using document type 3EJFO. This lodgement will require you to upload a document, and the Court will review the lodgement.

A 21 day period after the plaintiff due date applies for the Setting Down for Trial fee, when any party may pay this fee using document type 3ESDO. This lodgement will not require you to upload a document, and the Court will not review the lodgement. If the fee is not paid by the new ‘due date’, the trial date will be vacated.

Can I file exhibits with an affidavit?

Yes, under Rule 43 of the County Court Civil Procedure Rules, you must attach referenced exhibits to affidavits when they’re eFiled. This includes the following Additional filing document types:

  • 2AFF – Affidavit
  • 2AFOM – Affidavit in Response to Originating Motion
  • 2AOS – Affidavit of Service
  • 242AA – Affidavit of Service of 42AA Subpoena on Solicitor
  • 242AS – Affidavit of Service of Subpoena on Addressee.

If one or more of your affidavit exhibits are claimed to be confidential, you must file these exhibits separately to the affidavit. You can do this via Additional Filing by selecting an Affidavit (2AFF) document type.

A 40 MB document upload limit applies to all affidavits and to a Statement of Expert Witness filed (2SEW)  document type.

If the document exceeds the current file size limit, please contact our Customer Service Centre on confirm@citec.com.au, and we’ll attempt to reduce the size of the document. If this isn’t possible, we’ll send the document through to the Court for filing.

How will the Court fee be determined for an Additional filing document?

For documents that are subject to a court statutory fee, the court fee rate that applies depend on the case parties that you’re filing the document on behalf of. Either a corporate, standard or concession fee rate will apply.

Once you select parties from the ‘Filed On Behalf Of’ list, a ‘Determine Fee Rate’ button will become available. Depending on the case parties you’ve selected, you must provide further information about these case parties for the fee rate to be determined.

Court statutory fees

For the following document types, only one set court statutory fee will apply:

  • 2CJI – Certificate of Judgment
  • 3EJF1 – First day jury fee before due date
  • 3JF2 – Jury fee – 2nd – 6th day
  • 3JF7 – Jury fee – 7th day (and subsequent days)
  • 3EJF0 – First day jury 14 day period

Are additional filings reviewed by the court?

Court review depends on the type of document filed.

Documents that do not require review will initially show a status of ACCEPTED in Filing Results. This will change to a status of FILED once processing has been completed successfully.

Documents that require review will initially show a status of PENDING in Filing Results. The documents requiring review may be cleared on the same day, with a priority processing period between 10 – 11.30am. Lodgements made after 4pm may be cleared by 10am the following day.

These times apply to Victorian business days only and may be subject to change without notice.

You are only charged for the filing after the review has taken place and the document has been successfully filed with the County Court.

If your account has search receipts enabled, documents submitted for review will not display a search receipt with your acknowledgement at the time of submission.

How do I change my email address for service?

Your email address for service is stored for you in our system.

You can update this email address at any time when you file documents via Add or change party. Or, you can update it directly by filing a Notice of change of email address for service via Add or change party.

How do I file a Solicitor Ceasing to Act?

You can file your Solicitor Ceasing to Act via Add or change party. If known, you can provide an alternative email address for service for this party.
